Free Appropriate Education (FAPE)

Laws Relating to Students with Disabilities 

There are three laws that protect students with disabilities. These laws ensure that no restrictions be placed on their right to secure the benefits of a Free Appropriate Public Education (FAPE). The three laws are:  

  • PL 93-112 or Section 504 of the Rehabilitation Act of 1973 (503)
  • Title I of the Americans with Disabilities Act of 1990 (ADA)  
  • PL 105-17 Individuals with Disabilities Education Act of 2005, Reauthorization. (IDEA)

A student eligible for special education under the Individuals with Disabilities Education Act (or the Individuals with Disabilities Education Improvement act as of July 1, 2005) is automatically protected under Section 504 and Title I of the Americans with Disabilities Act. The IDEA (or IDEIA) ensures that children with disabilities who qualify for special education services are provided a Free Appropriate Public Education with specially designed instruction and related services designed to meet the unique educational needs of the student.
